Daniel Penny

Well we overcame one hurdle in the case of Daniel Penny. A New York judge dismissed the charge of manslaughter. But unfortunately he’s not out of the woods yet as the jury still has to decide on the charge of negligent homicide. This charge is when someone acts negligent careless) and causes the demise of someone! In New York one is guilty if the defendant failed to perceive a substantial and unjustifiable risk. In Penny’s case, this charge does not fit. Penny actions was justified! The deceased, Jordan Neely was acting a fool on the train stating he had no problem leaving the planet that day and taking others with him. Penny knew that the police are not coming. And they have a hands-off attitude. Penny feared for his safety and the safety of other passengers on that subway car.

But; here’s something we haven’t seen. His confession to police. Penny admits that his intent was to stop Jordan Neely. Penny paints a picture of what was happening on that subway car. He didn’t ask for a lawyer. He freely spoke to the police. Why? He had nothing to hide and felt that Neely was a threat! But no, Alvin Bragg who is too busy charging Donald Trump on bogus charges has to go after this kid while Manhattan Island becomes Escape from New York.
